NOTICE OF PROPOSED ORDINANCE 2019-01 AMENDING SECTION 150.114 OF THE CITY CODE GOVERNING ISSUANCE OF PERMITS FOR UTILITIES WITHIN A RIGHT-OF-WAY

NOTICE IS HEREBY GIVEN that the City Council of Jordan, Scott County, Minnesota, will vote on the proposed ordinance 2019-01 to address Federal Communications’ declaratory ruling (FCC 18-133) regarding small wireless facilities.  The Federal Communications Commission published a declaratory ruling regarding ordinances that restrict small wireless facilities.  The ruling set forth separate shot clocks for a city’s review of permit applications associated with new versus existing support structures within the right-of-way, and requires ordinances that include aesthetic requirements to be (1) reasonable, (2) no more burdensome than those applied to other types of infrastructure deployments, and (3) objective and published in advance.  Chapter 150 of the Jordan City Code includes a 90-day shot clock and aesthetic requirements applicable to small wireless facilities.

Amending City Code Section 150.114 is necessary to identify separate shot clocks for new versus existing support structures within the right-of-way and apply the objective aesthetic requirements to both small wireless facilities and other facility deployments.

The vote will occur at the February 19, 2019 meeting at 6:30 p.m. or shortly thereafter, at the Jordan City Council Chambers, located at 116 East First Street in the City of Jordan, Minnesota.
