PUBLIC NOTICE and OPPORTUNITY FOR COMMENT
In accordance with 23 CFR 774.5, MnDOT and Scott County are soliciting comments on the effects this project would have on Riesgraf Lions Park. A new trail will be constructed through Riesgraf Lions Park to connect the new pedestrian underpass to Creek Ln. Approximately 0.55 acres of the park will be impacted during construction. MnDOT is seeking a temporary easement for this area to construct the trail. The City of Jordan will continue to own and maintain the park following construction.
The Federal Highway Administration (FHWA) has made a preliminary determination that the proposed action at Riesgraf Lions Park is a Section 4(f) de minimis action in accordance with 23 CFR 774.5, conditioned on public review and comment. A de minimis finding may be made when uses of Section 4(f) land will have no adverse effect on the protected resources.
